Je comptais fermer mon site Classical Music Mobile en ce début d'année 2015. Pourquoi ? Parce que la totalité des enregistrements disponibles sur le site sont libres de droits. On ne parle pas ici des droits d'auteur (70 ans après le décès du compositeur) mais des droits voisins, ceux des interprètes, qui s'éteignent 50 ans après la parution de l'enregistrement. Or l'Union Européenne a publié une directive qui étend ce droit de 50 à 70 ans, et la France vient d'inscrire cette modification dans son droit. Je prévoyais donc de saborder mon site.
Mais je n'aurais pas à le faire : ce passage de 50 à 70 ans n'est pas totalement rétroactif, la loi précise en effet que les enregistrements tombés dans le domaine public en 2013 (donc tous ceux publiés jusqu'en 1962 inclus) ne quitteront pas le domaine public ; ce sont les enregistrement publiés en 1963 et après qui verront leur protection passer à 70 ans, comme l'explique l'étude d'impact du texte de loi :
En conséquence la totalité de mon site demeure parfaitement légal, et on peut même continuer à l'alimenter avec des enregistrements sortis en 1962 au plus tard ! Les plus de 1.600 enregistrements MP3, (dont 275 en stéréo) demeurent parfaitement valides et peuvent continuer à s'étendre.
Cependant l’offre doit changer : 1 euro l’enregistrement représentait un très bon rapport qualité/prix lorsque le site est né il y a une dizaine d’années, mais désormais, avec le streaming, les offres numériques et les prix cassés sur le CD, elle n’est plus compétitive. Il faut trouver une autre formule, plus intéressante et moins coûteuse en fonctionnement. Je souhaite y arriver, et si vous voulez participer à l’aventure, n’hésitez pas à prendre contact. En attendant, le site est mis en stand-by.
